The European project European and Latin American Systems of Ethics Regulation of Biomedical Research Project (EULABOR) has carried out the first comparative analysis of ethics regulation systems for biomedical research in seven countries in Europe and Latin America, evaluating their roles in the protection of human subjects. We developed a conceptual and methodological framework defining ‘ethics regulation system for biomedical research’ as a set of actors, institutions, codes and laws involved in overseeing the ethics of biomedical research on humans. This (...) framework allowed us to develop comprehensive national reports by conducting semi-structured interviews to key informants. These reports were summarised and analysed in a comparative analysis. The study showed that the regulatory framework for clinical research in these countries differ in scope. It showed that despite the different political contexts, actors involved and motivations for creating the regulation, in most of the studied countries it was the government who took the lead in setting up the system. The study also showed that Europe and Latin America are similar regarding national bodies and research ethics committees, but the Brazilian system has strong and noteworthy specificities. (shrink)

Humans’ interactions with each other or with socially competent machines exhibit lawful coordination patterns at multiple levels of description. According to Coordination Dynamics, such laws specify the flow of coordination states produced by functional synergies of elements (e.g., cells, body parts, brain areas, people…) that are temporarily organized as single, coherent units. These coordinative structures or synergies may be mathematically characterized as informationally coupled self-organizing dynamical systems (Coordination Dynamics). In this paper, we start from a simple foundation, an elemental model (...) system for social interactions, whose behavior has been captured in the Haken-Kelso-Bunz (HKB) model. We follow a tried and tested scientific method that tightly interweaves experimental neurobehavioral studies and mathematical models. We use this method to further develop a body of empirical research that advances the theory toward more generalized forms. In concordance with this interdisciplinary spirit, the present paper is written both as an overview of relevant advances and as an introduction to its mathematical underpinnings. We demonstrate HKB’s evolution in the context of social coordination along several directions, with its applicability growing to increasingly complex scenarios. In particular, we show that accommodating for symmetry breaking in intrinsic dynamics and coupling, multiscale generalization and adaptation are principal evolutions. We conclude that a general framework for social coordination dynamics is on the horizon, in which models support experiments with hypothesis generation and mechanistic insights. (shrink)

Critics have charged that John Stuart Mill''s discussion as of paternalism in On Liberty is internally inconsistent, noting, for example, the numerous instances in which Mill explicitly endorses examples of paternalistic coercion. Similarly, commentators have noted an apparent contradiction between Mill''s political liberalism – according to which the state should be neutral among competing conceptions of the good – and Mill''s condemnation of non-autonomous ways of life, such as that of a servile wife. More generally, critics have argued that while (...) Mill professes an allegiance to utilitarianism, he actually abandons it in favor of a view that values personal autonomy as the greatest intrinsic good. This paper presents an interpretation of Mill that provides a viable and consistent treatment of paternalism, thereby refuting each of the aforementioned critiques. Mill''s views, it argues, are consistently utilitarian. Moreover, the interpretation accounts for all of Mill''s departures from his otherwise blanket prohibition of paternalistic legislation. In particular, it explains his most notorious example, the condemnation of voluntary contracts for slavery. The interpretation emphasizes Mill''s conceptual linkage between autonomy and utility, noting his implicit use of at least three different senses of the notion of autonomy. (shrink)

Can events that take place after an individual’s death affect that person’s weIl-being? Aristotle apparently thought that they could, but Mark Overvold disagrees. Like other contemporary moral theorists, Overvold analyzes the notion of a person’s utility or welfare in terms of the fulfillment of the individual’s desires, but he adds the important qualification that the desites must be for states-of-affairs in which the agent is an essential constituent. The clear implication of such a view is that our welfare cannot be (...) affected by the post-mortem satisfaction of any of the interests which we had while alive.I shall defend Overvold against his critics who insist that at least some posthumous satisfactions can contribute to a person’s welfare. I shall also argue against Brad Hooker’s proposal that we revise Overvold’s theory in order to account for such cases. (shrink)

The book is divided into two parts, the shorter of which documents and discusses the authoritative and Biblical sources for the Christian, and specifically Catholic, notion of natural law. The second section is taken up with conceptual analyses of such notions as the relation between nature and grace, nature and historical situation, and primary and secondary determinations of the natural law. A final chapter considers the possibility and scope of a Christian Sociology. The, in principle, complete integration of nature and (...) grace is maintained throughout in opposition to what Fuchs types as the postulated antinomy between these two orders that characterizes most Protestant theologies. In my commentary I will try to illustrate the fruitfulness of his approach by pointing to some connections with the phenomenology of the body as well as with recent memory and infant research.As Blankenburg himself indicates, the (...) notion of common sense developed by a shift of meaning from the classical sensus communis and thus has its original basis in the sensual-bodily experience. By the koinè aísthesis, Aristoteles meant a central sense organ integrating all single modalities of sensation (which he localized in the heart). In German physiology and psychiatry of the nineteenth century, the sensus communis was still translated as "Gemeingefühl" ("common feeling") or "cenesthesia" (Fuchs 1995). This term denoted the inner, proprioceptive bodily sensations, but also an original unity of the senses, which has been rediscovered by recent infant research as intermodal sensory perception. The affection of the body was thus regarded as the common basis of all sensation.Looking on this track for a bodily basis of the common sense, we find it in the habitual structure of the lived-body as analysed by Merleau-Ponty (1945). The body is the primary "matter-of-course," namely, the tacitly functioning medium of our everyday being-in-the-world prior to any subject-object split. The body schema, in Merleau-Ponty's view, is not only a system of familiar units of movement or "kinetic melodies," it also incorporates the surrounding things, tools, and spaces that are familiar to us and that we "inhabit." Thus, the musician "does not only manipulate the instrument like a separate object, but lives in it like a limb and inhabits the expressive musical space it opens" (Behnke 1997). But for Merleau-Ponty, the body schema is also the basis of "intercorporeity," i.e., a prepersonal sphere of reciprocal comportment and understanding prior to any explicit consensus and symbolic communication. In this sphere of elementary contact, the "atmospheric" senses play a major role: The sense of smell (as shown, e.g., by the expression "to scent treason" or in German, "jemand nicht riechen können" [not be able to "smell" or stand someone]) as well as the sense of taste whose ambiguous meaning, mentioned by Blankenburg, points to the bodily basis of the feeling for what is suitable, decent, or aesthetically pleasing. Even the designation of homo sapiens that we give to ourselves is derived from the latin sapere (to taste/to know), and thus shows that the knowledge characteristic for man is not an explicit one, but an intuitive, implicit knowing or "feel" for his surroundings, or as Kant says, an "aesthetic rather than intellectual judgment" (cited by Blankenburg).Polanyi (1967) has analysed this knowledge at the roots of common sense as "tacit knowledge." It is based on processes of Gestalt formation that enable us to grasp unified wholes through their constituting elements without still being aware of the latter. Thus, we understand the facial expression of others immediately but cannot tell from which details. Tacit knowledge implies all the taken-for-granted that we have forgotten once it has become our second nature and part of our bodily habits. This unconscious knowing has only recently come to be explored by psychology under the heading of "implicit" or "procedural memory" (Schacter 1987, 1996). It contains familiar styles or "melodies" of moving, perceiving, and being-with-others in which our whole bodily and emotional experience is engaged. There is an atmospheric, "felt" quality about them that cannot be analysed into single elements. Implicit knowledge may, therefore, never be wholly expressed by words—it is only realized in the concrete situation. Cephalopods are extraordinary molluscs equipped with vertebrate‐like intelligence and a unique buoyancy system for locomotion. A growing body of evidence from the fossil record, embryology and Bayesian molecular divergence estimations provides a comprehensive picture of their origins and evolution. Cephalopods evolved during the Cambrian (∼530 Ma) from a monoplacophoran‐like mollusc in which the conical, external shell was modified into a chambered buoyancy apparatus. During the mid‐Palaeozoic (∼416 Ma) cephalopods diverged into nautiloids and the presently dominant coleoids. Coleoids (i.e. squids, cuttlefish (...) and octopods) internalised their shells and, in the late Palaeozoic (∼276 Ma), diverged into Vampyropoda and the Decabrachia. This shell internalisation appears to be a unique evolutionary event. In contrast, the loss of a mineralised shell has occurred several times in distinct coleoid lineages. The general tendency of shell reduction reflects a trend towards active modes of life and much more complex behaviour. (shrink)

Current theories of social cognition are mainly based on a representationalist view. Moreover, they focus on a rather sophisticated and limited aspect of understanding others, i.e. on how we predict and explain others’ behaviours through representing their mental states. Research into the ‘social brain’ has also favoured a third-person paradigm of social cognition as a passive observation of others’ behaviour, attributing it to an inferential, simulative or projective process in the individual brain. In this paper, we present a concept of (...) social understanding as an ongoing, dynamical process of participatory sense-making and mutual incorporation. This process may be described (1) from a dynamical agentive systems point of view as an interaction and coordination of two embodied agents; (2) from a phenomenological approach as a mutual incorporation, i.e. a process in which the lived bodies of both participants extend and form a common intercorporality. Intersubjectivity, it is argued, is not a solitary task of deciphering or simulating the movements of others but means entering a process of embodied interaction and generating common meaning through it. This approach will be further illustrated by an analysis of primary dyadic interaction in early childhood. (shrink)

Background: Informed consent is a legal as well as ethical prerequisite in clinical research. For dementia research, informed consent can be a problem if subjects with dementia, whose capacity for understanding and thus also decision making might be limited, are to be exam- ined. This might result in exclusion of dementia patients from research, as capacity for understanding and decision making are often equated with the ability for rational decision making. However, this valuation has been criticized at times for attaching (...) too much impor- tance to the cognitive aspect of decision making. -/- Methods: This qualitative study investigates the actual consent procedure of a clini- cal research study in Germany with regard to dementia patients’ subjective and objective understanding of informed consent information. Research participants were ten dementia patients, who volunteered in two clinical research studies, as well as their caregivers. Data were collected by use of semi-structured interviews. -/- Results: It was determined that the patients’ comprehension of informed consent infor- mation was rather limited. However, a number of patients were quite aware of this. In con- trast, all caregivers claimed to have fully understood the provided information, while their objective comprehension was also incomplete. Several participants indicated that they did not attach much importance to the information given in the consent procedure and that their consent did not primarily depend on this information. Rather, participation in the research study for them seemed to be more of a problem-focused coping strategy for dealing with their diagnosis of dementia. -/- Conclusion: For research ethics these results raise the question whether the currently prevailing emphasis on the cognitive aspect of autonomous decision making, i.e., compre- hension, may be too one-sided, and to what extent the “volitional” aspect in giving consent should be given greater consideration. Not only our conscious expectations, wishes and intentions are directed towards the future, but also pre- or unconscious tendencies, hunches and anticipations. Using a term of Ernst Bloch, they can be summarized as the not-yet-conscious. This not-yet-conscious mostly unfolds spontaneously and without plan; it is not directly anticipated or aimed at, but rather comes to awareness in such a way that the subject is, as it were, surprised by itself. Thus it gives rise to phenomena such as the striking, the (...) coincidental, the new, and the improvised, which are particularly important for understanding creative and therapeutic processes. The paper aims at providing a general phenomenological framework for the understanding of not-yet-conscious dynamics and their unfolding in different contexts. To this end, the structure of the not-yet-conscious is examined in light of protention, in which the phenomenon is fundamentally to be located. I propose to describe the general structure of protention as a future-directed horizon of graded probabilities, i.e., as a “protentional cone”. This cone is fed by current experiences and bodily tendencies and is focused to varying degrees by attention. This results in either more focused or rather defocused states of anticipation, the latter giving space to the not-yet-conscious as a meaning “in statu nascendi”. On this basis, selected manifestations of the not-yet-conscious are analyzed, including extemporaneous speech, artistic improvisation and creativity, bodily meaning implicates, decision-making, and meaningful coincidence. The distinction of „understanding“ and „explaining“, formulated by Karl Jaspers in his „General Psychopathology“, has had a lasting effect on psychiatry. As a result, phenomenological, hermeneutic, or psychodynamic approaches have often been accorded only descriptive or epiphenomenal status, while the actual causes of mental illness have been sought in neurobiologically or genetically based explanations. In contrast, this paper defends the explanatory role of understanding and phenomenological approaches. To this end, two levels of explanation are distinguished and shown to be equally (...) justified in principle, namely, motivational explanation at the macro-level and physical explanation at the micro-level. The actual causal role of motivational, i.e., understandable connections is then demonstrated by means of a conception of circular causality, which includes downward causality. Finally, the explanatory role of phenomenological analyses is also shown in psychotic disorders that refuse motivational understanding, using the example of schizophrenic delusion. (shrink)

From a neuroconstructivistic point of view, the human brain produces an internal simulation of the external world which appears in conscious experience as the phenomenal world. This concept implies in particular that the subjective body and the organic or objective body belong to fundamentally different realms, i.e. to the mental and the physical world. The spatiality of the subject-body has then to be declared an illusion, which is done by pointing to dissociations of the subject- and object-body as in the (...) rubber hand illusion or in phantom limbs. This alleged virtuality of body experience may be refuted, however, namely by referring to the intersubjectivity of perception which certifies the coextensivity of subject-body and object-body. Subjectivity is thus shown to be embodied as well as spatially extended, that means, as bodily being-in-the-world. (shrink)

Problem: Visions of technology, future scenarios, guiding visions represent imaginations of future states of affairs that play a functional role in processes of technological research, development and innovation—e.g. as a means to create attention, communication, coordination, or for the strategic exertion of influence. Since a couple of years there is a growing attention for such imaginations of futures in politics, the economy, research and the civil society. This trend concerns technology assessment as an observer of these processes and a consultant (...) on the implications of technology and innovation. TA faces increasing demands to assess imaginations of futures that circulate in the present and to participate in shaping these through scenarios or foresights. More than ever, this raises the question, which propositions can be made based on these imaginations by TA and how this can be used in advisory practices. Imaginations of futures are relevant for TA not as predictions but in their significance and effectiveness in the present, which need to be understood and assessed.Contents: This discussion paper outlines how present significance and effects of imagined futures in technological research and innovation processes can be conceived and analyzed. In this paper, all forms of imaginations of technology futures will be called “socio-technical futures” because within them technological developments and social changes are interwoven and inseparably interrelated. In this paper, we discuss why TA should analyze socio-technical futures, how such analyses can grasp the societal conditions that are expressed in the imagined futures and how these become effective in processes of technology development, communication, decision making etc. We raise the question which self-reflexive positioning or possible realignment of TA is needed as a response to its increased concern with assessing and even co-producing socio-technical futures. The latter is often demanded regarding the growing attention by politics and publics to imaginations of futures with wide temporal and spatial reach.Addressee of this paper is the TA community in a broader sense. The aim is to sensitize colleagues for the topic and its challenges, to consolidate discussions and to provide theoretical and methodical suggestions for research in TA and related advisory practices with respect to socio-technical futures. This paper has been originally initiated during the workshop “The present of technological futures-theoretical and methodical challenges for Technology Assessment”, in which all of the paper’s authors participated. This paper develops a phenomenological analysis of the disturbances of self-experience in dementia. After considering the lack of conceptual clarity regarding the notions of self and person in current research on dementia, we develop a phenomenological theory of the structure of self-experience in the first section. Within this complex structure, we distinguish between the basic level of pre-reflective self-awareness, the episodic sense of self, and the narrative constitution of the self. In the second section, we focus on dementia and argue (...) that, despite the impairment of narrative self-understanding, more basic moments of self-experience are preserved. In accordance with the theory developed in the first part, we argue that, at least until the final stages of the illness, these self-experience in dementia goes beyond the pure minimal self, and rather entail forms of self-reference and an episodic sense of self. l investigate versions of the Maximality Principles for the classes of forcings which are <κ-closed. <κ-directed-closed, or of the form Col (κ. <Λ). These principles come in many variants, depending on the parameters which are allowed. I shall write MPΓ(A) for the maximality principle for forcings in Γ, with parameters from A. The main results of this paper are: • The principles have many consequences, such as <κ-closed-generic $\Sigma _{2}^{1}(H_{\kappa})$ absoluteness, and imply. e.g., that ◇κ holds. I give an application (...) to the automorphism tower problem, showing that there are Souslin trees which are able to realize any equivalence relation, and hence that there are groups whose automorphism tower is highly sensitive to forcing. • The principles can be separated into a hierarchy which is strict, for many κ. • Some of the principles can be combined, in the sense that they can hold at many different κ simultaneously. The possibilities of combining the principles are limited, though: While it is consistent that MP<κ-closed(HκT) holds at all regular κ below any fixed α. the "global" maximality principle, stating that MP<κ-closed(Hκ ∪ {κ}) holds at every regular κ. is inconsistent. In contrast to this, it is equiconsistent with ZFC that the maximality principle for directed-closed forcings without any parameters holds at every regular cardinal. It is also consistent that every local statement with parameters from HκT that's provably <κ-closed-forceably necessary is true, for all regular κ. (shrink)

A core area of pragmatics is conversational implicatures, where speakers imply a meaning that is not part of what is literally said. Not all people have the ability to easily understand such common (implicit) forms of communication. For these people, Easy Language has been developed, i.e. a form of barrier-free communication with substantially simplified syntax and lexis. Moreover, Easy Language is based on the principle of maximum explicitness. However, the heterogeneous target groups and the different types of implicature have not (...) been systematically taken into account. Therefore, this article is the first to take an in-depth look at conversational implicatures in Easy Language. It shows that a universal principle of maximum explicitness for Easy Language is too short-sighted. Instead, the principle of explicitness must be considered in relation to the different target groups and the types of implicature. The article provides an impulse for further (empirical) research in this emerging field. (shrink)

In the analysis of the blurry $$\textsf{HOD}$$ hierarchy, one of the fundamental concepts is that of a leap, and it turned out that critical leaps are of particular interest. A critical leap is a leap which is the cardinal successor of a singular strong limit cardinal. Such a leap is sudden if its cardinal predecessor is not a leap, and otherwise, it is smooth. In prior work, I showed that the existence of a sudden critical leap is equiconsistent with the (...) existence of a measurable cardinal. Here, I show that if the cofinality of the cardinal predecessor of a sudden critical leap is required to be uncountable, the consistency strength increases considerably. I also show that when focusing on critical leaps whose cardinal predecessors have uncountable cofinality, the consistency strength of a smooth critical leap is much lower than that of a sudden critical leap. Finally, I observe that in contrast to the countable cofinality setting, $$\aleph _{\omega _1+1}$$, e.g., cannot be a sudden critical leap. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:BOOK REVIEWS 155 Humanae Vitae: A Generation Later. By JANET SMITH. Washington, D.C.: The Catholic University of America Press, 1991. Pp. xvi + 425. $42.95 hardcover; $17.95 paper. This is an ambitious and important study. I will first offer an overview of the volume to indicate its scope and note some of its major features. I will then respond briefly to some of the major criticisms Smith makes of (...) the argument against contraception advanced by Germain Grisez, Joseph Boyle, John Finnis, and myself. The work contains 8 chapters and 4 appendices. Chapters 3 and 4, as Smith says, "provide an analysis of Humanae Vitae itself and thus constitute the heart of the hook" (p. xi). Since this is so I will first summarize briefly Chapters 1, 2, 5, 6, 7, and 8 and then center atten· tion on the two central chapters and the four appendices. Chapters 1 and 2 provide the context for Humanae Vitae. The first chapter is devoted largely to an account of the so-called " Minority " and "Majority" documents of the Papal Commission for the Study of Problems of the Family, Population, and Birth Rate, while the second seeks to summarize Catholic teaching on Christian marriage prior to the encyclical. This summary draws principally from Pius XI's Casti Connubii and from nn. 47-52 of Vatican II's Gaudium et Spes. Smith takes up in some detail the issue of the" primacy" of procreation, concluding that Gaudium et Spes " seems to sidestep " this issue which, in her judgment, is irrelevant to the question of contraception. She thinks that this central document of Vatican II sent " mixed signals " on the question of contraception, although she believes that several passages " can very plausibly he read to support the position that contraception is portrayed as a violation not only of the procreative good of marriage hut also of the values of conjugal love" (p. 66). Chapter 5 deals with a wide range of theological issues: the biblical foundations for the teaching found in Humanae Vitae, the relevance of the concept of munus for this teaching, the possibility of acting " in good conscience " in a way contrary to its teaching, and the infallibility of the teaching. Of special value is the extended discussion of the con· cept expressed by the Latin term munus. Smith examines the rich meaning of this term in several magisterial documents, including Gaudium et Spes as well as Humanae Vitae. While a munus implies duties, it is essentially a noble, honor-bringing "gift" or "reward," signifying a vocation and sublime honor. Paul VI, in developing the integral vision of marriage in his encyclical, uses this concept to show that God, in giving to spouses the munus of handing on new life, has conferred on them the honor of sharing with him in the work of bring· 156 BOOK REVIEWS ing new life into the world. Smith shows beautifully how the rich theological meaning of this term helps " illuminate and enrich " the teaching of the encyclical. Chapters 6 and 7 investigate the arguments presented by dissenting theologians after Humanae Vitae to justify their repudiation of its teaching. In Chapter 6 Smith considers the views of Charles Curran and Bernard Haering, while in Chapter 7 she examines the proportionalist approach to moral issues developed by Joseph Fuchs, Richard McCormick and others. She provides intelligent criticism both of Curran and Haering and of proportionalist thought, focusing on the repudiation of specific moral absolutes. In Chapter 8 Smith provides a very helpful summary of Pope John Paul II's understanding of the human person, human sexuality and marriage. In particular, she takes up his notion that in marriage and in the act proper rto it man and woman make a " gift " of themselves to one another. Simultaneously to choose to give themselves to each other in the marital act and to contracept is then seen to involve an inner contradiction, a falsification of the " language of the body " (pp. 230258 ). Smith also takes up some of the major criticisms levelled against John Paul II's thought, in particular Lisa Sowle Cahill's, which charges him with an overromantic view of love and a failure to recognize that... Alphonso Lingis is unabashed in his uses of we. He does not speak about a privileged we, an exemplary or hegemonic we, or "we." According to this American philosopher, the various ways critics qualify their references to first person plural (we, us, our) are unnecessary, if not unjustifiable. Their caution and skepticism about any direct use of we invariably lead one to focus on this important pronoun as if it were a rhetorical sleight of hand, an ironic twist, a sign of embarrassment or elitism. Worse, their gradual cynicism diminishes or derides the reality of those whose contact with others can only be articulated in terms of we or our. Thus readers, and students subject to these theoretical reservations, are tempted to circumvent any substantive meaning to first-person plural in their own reflections and research. Given the persuasive charms of these reservations, to admit a genuine or lived we involves the risk of being charged with superficiality, a lack of sophistication, nostalgia, or political naiveté. 1In the face of this risk, Lingis writes in first-person plural without apology. Seemingly oblivious to the ongoing controversies over any legitimate use of we—as if it connoted self-indulgence or self-delusion, Lingis depicts experiences and contacts that embody a substance to first-person plural. These contacts are presented directly and with little hesitation, as they often move one to awaken to daring, brazen, or unfamiliar individuals in their contexts and surroundings. To present them requires an air of innocence to the extent that the contacts appear as new to the writer as they are to the reader. [End Page 11]They encompass more than surprise and spectacle. They also initiate beliefs and emotions that embrace other truths: unfamiliar expressions of gods, strange forms of human commitments, eccentric relations humans have with the past and future, but also with animals, trees, and unseen spirits. These truths evoke the kinds of genuine goods and values that are better conceived not as potential instantiations or counterexamples to our generalizations and conventions, but rather as compelling additions to our own senses of reality and truth.In writing about we or us, however, Lingis also raises some critical stakes. While conversant with most of the influential figures and themes discussed under the postmodern rubric, Lingis extends their central ideas to new levels and fields of inquiry. Instead of scrutinizing the uses of first-person plural or maintaining a respectable distance from them, his philosophical endeavors are distinct insofar as they address: How do we, he and his audience, respond to the many kinds of contact that are readily dismissed insofar as they overlooked in our scholarly and philosophical endeavors? What might these other uses and realities of the first-person plural say that affirm, question, or contest us? Can his own work, lucidly presented in five recent books, contribute to contemporary discussions about the possibilities and pitfalls of human relations, cultural and political entities, social and biological communities, and the theoretical or critical reflections on them? 2 Lingis's answers are guided by looking at we more as a collage and less as a collective. A collage, unlike a collection, emphasizes or highlights the unpredictable ways that humans and other life forms come together. The use of we as a collective—whether the result of unconscious drives, chosen ideologies, an intersubjective ethic, or rational communication acts—emphasizes certain values, particularly those that help us to distinguish whether the experiences of we can be understood or appreciated in terms of true or false, good or bad, genuine or superficial, beautiful or ugly, familiar and significant terms for making judgments about moral, social, and... This pre-registered replication study explores the impact of perceived cuteness on the evolution of cultural artifacts, testing whether neotenic traits – eye size, forehead height, and head roundness – have increased in teddy bears over time. In previous research, Hinde & Barden (1980) found an increase in teddy bear neoteny while Gould (1985) found that Mickey Mouse’s features became more neotenic with time. However, both studies lacked statistical power (15 teddy bears and 3 Mickey Mouse drawings). We collected data from (...) eight major teddy bear manufacturers over nine decades (N = 250; 1900–1980). We found that the forehead height of teddy bears significantly increased over time. Conversely, our prediction that heads became rounder and eyes became bigger were not supported. We outline four key methodological limitations that future research should address to deepen our understanding of the cultural evolution of cuteness and of cultural artifacts more broadly – i.e., sampling bias, metadata inaccuracy, categorization ambiguity, and function ambiguity. Objectives To evaluate whether the requirement of “minimal risk and burden” for paediatric research without direct benefit to the subjects compromises the ability to obtain data necessary for improving paediatric care. To provide evidence-based reflections on the EU recommendation that allows for a higher level of risk. Design and setting Systematic analysis of the approval/rejection decisions made by the Dutch Central Committee on Research involving Human Subjects (CCMO). Review methods The analysis included 165 proposals for paediatric research without direct benefit (...) that were reviewed by the CCMO between January, 2000, and July, 2007. A separate, in-depth analysis of all drug studies included 18 early phase drug studies and nine other drug studies without direct benefit. Results 11 out of 165 studies were definitively rejected because the CCMO did not regard the risk and/or burden to be minimal. In three of these 11 cases (including two early phase drug studies) the requirement of minimal risk and burden was cited as the only reason for rejection. Four other early phase drug studies also involved risks and/or burdens that were not regarded to be minimal but were nevertheless approved. Conclusions The requirement of minimal risk and burden, aiming to protect research subjects, occasionally leads to rejection of protocols. Early phase drug studies relatively often do not comply with the requirement. Committees may find ways to approve important studies that formally should be rejected, but that is not a desirable solution. The regulatory framework should be revised to make such occasional exceptions to the requirement legitimate and transparent. (shrink)

John Paul II’s encyclical Veritatis Splendor lists several objections to the theological concept of fundamental option. This article summarizes that concept, primarily as presented by Josef Fuchs. It then locates the concept, as Fuchs did, in the overarching theological anthropology of Karl Rahner, which is discussed at length. The objections of the encyclical are then engaged. In some cases, it is shown, the encyclical misunderstands fundamental option. In other cases, its rejection of the idea seems to entail rejection (...) also of traditional Catholic doctrines. All this leads to concluding reflections in which fundamental option is evaluated in terms of its cogency, adequacy, usefulness, and necessity for a contemporary Christian anthropology. (shrink)
